Listens Beta Program Agreement

This Listens Beta Agreement ("Agreement") outlines the terms and conditions under which you ("Tester") may participate in the beta testing program for the Listens mobile application.

1. Introduction to Listens

Listens is a voice-controlled application designed to help users create and manage various types of lists faster and more efficiently than traditional methods like typing or pen and paper.

2. Grant of License

Subject to the terms of this Agreement, the Developer of Listens grants you a non-exclusive, non-transferable, revocable license to use the Listens beta application ("Beta App") for the sole purpose of testing and providing feedback. The Beta App is provided "as is" and is not warranted to be error-free or fully functional.

3. Purpose of Beta Testing

The primary purpose of this beta program is to obtain your feedback on the performance, features, and usability of the Listens app before its general release. We are particularly interested in your experience with:

• The "fluid speech modality" and how it allows for natural, conversational list creation, moving fluidly from thinking to speaking.
• The "intentional listening" feature, activated by a touch and hold gesture anywhere on the screen, which ensures the app only listens when you explicitly invoke speech mode.
• The "orders of magnitude faster data entry" achieved by stacking commands and issuing multiple instructions at once.
• The "focus-free user experience," allowing you to operate the app without constantly looking at your phone.
• The accuracy of the app's semantic interpretation when creating lists, such as categorizing "head of romaine lettuce produce".
• The overall ease of use and speed for everyday activities.
• The effectiveness of the design based on "universal design principles," including accessibility for older users, as the voice controls have been tested with elderly people and found to work "fabulously".

4. Tester Obligations and Feedback

As a Tester, you agree to:

• Actively use the Beta App and test its various functionalities, including creating the available list types: simple lists, numbered lists, checklists, progress lists, priority lists, and pros and cons lists.
• Provide timely and constructive feedback on bugs, errors, usability issues, performance, and suggestions for improvements. This includes feedback on the voice commands, user interface, and overall stability.
• Utilize the "interactive help feature" available at the bottom of every view to understand available voice commands in specific contexts and provide feedback on its clarity and usefulness.
• Report any issues related to data security and privacy, given the emphasis on safely storing data.

5. Data Security, Privacy, and Collaboration

Listens prioritizes data security and privacy.

• Data you enter will be safely stored on your phone.
• If you choose, you can safely move your data to iCloud, where it benefits from the same security and privacy protocols as iCloud itself.
• You can share data with family, friends, or your Doctor when it is stored in the iCloud section, and they will only see what you want them to see and nothing more.
• You can also share your list subscriptions with family members through Apple's Family Share features.
• If you share a list with someone who does not have Listens installed, the share will prompt them to first install Listens and then open your shared list.

6. Known Limitations / Upcoming Features

Please be aware that the following functionalities are currently not available in this beta version but are planned for future releases:

• The ability to subscribe to additional specialized list templates (e.g., Grocery Lists, Inventory Lists, Shopping Lists, Expense lists, and many more, currently available for purchase in the full version at $0.99 and up) is "coming soon".
• The ability for users to create their own list templates is "not at present" but will be available in "an upcoming release".

We encourage your feedback on how the implementation of these features could further enhance your experience with Listens.

7. Confidentiality

The Beta App and any information about its features, functionality, and performance not publicly released, are considered confidential information. You agree not to disclose this confidential information to any third party without prior written consent. (This is a standard clause for beta agreements; while the app's data privacy is highlighted in sources, the confidentiality of the pre-release app features themselves is a common beta term.)

8. Disclaimer of Warranties

The Beta App is provided "as is" without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. The Developer of Listens does not warrant that the Beta App will meet your requirements or operate without interruption or error.

9. Limitation of Liability

To the maximum extent permitted by applicable law, the Developer of Listens shall not be liable for any damages arising out of the use or inability to use the Beta App.

10. Intellectual Property

All rights, title, and interest in and to the Listens app, including all intellectual property rights, belong to the Developer of Listens. This includes the innovative "fluid voice modality" and "intentional listening" features. The app is © Copyright 2025. Your participation in the beta program does not grant you any ownership rights in the Beta App.

11. Term and Termination

This Agreement begins upon your acceptance and continues until terminated by either party. The Developer of Listens may terminate this Agreement at any time, for any reason. Upon termination, you must cease all use of the Beta App.

12. Acceptance

By downloading, installing, or using the Listens Beta App, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this Agreement. If you have any questions, please feel free to reach out to us.
